Reaction on Dr Kambanda’s Genocide Statement Part 2

As we continue to receive views and comments these are the latest ones on facebook, Dr Kambanda’s statement appears to have caused instability in our community. We have also received threats, from some individuals that I will not mention at this moment. I urge those who have any personal issues or complains to direct them to [email protected]. Also anyone who thinks that these publications are tarnishing her or his name to contact Noble Marara who is the head of inyenyerinews.org, he is aware of all this. His email  [email protected]

Like I said everyone has the right to express their views, we are publishing according to what the Rwandans think in regards to the satement published a couple of days ago, for people to dig deep and see if there was any errors when decisions were made  naming ”Genocide” and that is all.

I argued that facts around the 1994 Rwandan massacres are inconsistent with the elements of the crime of genocide. Consequently, there is insufficient evidence to prove beyond a reasonable doubt all the elements of the crime of genocide….See More

Charles Kambanda Inyenyeri newspaper is probably out to confuse its readers. They continue publishing their narrow interpretation of the Genocide Statute and name calling. I wish Inyenyeri news kept it to an argument than calling me a ‘ genocide’ denier and other crazy things. I hope this is not any political party’s position. Sanity should prevail.

Yvan Ntwari As much as I despise the current GoR, I applaud them for being overzealous in enacting and enforcing laws on this issue of genocide denial. It is a very slippery slope and those of us who were there to witness our relatives getting killed and persecuted for years are thankful that the GoR draws that redline. This business of saying there were Tutsis also killing.. RPA also committed attrocities… etc.. all these arguments and legal analyses are really good and impressive, infact some even have some truth- But they dont change the conclusion that a Genocide was committed against the Tutsi. To me and others, our only reasoning is that we saw it happen. The fact is since the beginning of time, the victors have always written history, and for every version of the story. There will always distortions exaggerations and that favor an author’s personal inclinations whether it be in the RPF or opposition. Would anyone expect Kagame or Olivier or Mushikiwabo to speak out on the RPA’s role in killings? Never. Likewise we cannot expect the RPAs critics to sing praises for the regime. More scary however is the fact that many innocent Hutu’s who never committed any crime equally do not appreciate the banner and association with genocide (especially with GoR ridiculous policy of Nd’umunyaRwanda). With all the arguments, evidence, theories out there it can be tempting to draw from this well to make such conclusions like “There was no genocide against the Tutsi”.. At the end of the day, theorists, lawyers, journalists, pundits, spokesmen, from all sides of the aisle can share all their views because this is free speech, but survivors to witnesses, and victims , both Hutu and Tutsi – Somethings are just not up to debate, false equivalence or comparison. As Napoleon once said, ‘What is history, but a fable agreed upon?” Maybe one day when a different group wins they will sit down and change it to blame the Tutsi entirely, but for now, it is a fact and a conclusion that the genocide was committed against the Tutsi and anyone who suggests otherwise is wrong.

Yvan Ntwari As you can see these stories are not new and many more will come. I dont agree with the praise this author heaps on the Kigali regime but I commend his rejection of genocide denial. http://www.rnanews.com/…/3598-not-up-for-debate-rwanda…

Charles Kambanda Bosco Mutarambirwa, do you see any argument in the Inyenyeri news piece you posted? The author picked on some pieces from the Statute on genocide; he believes prosecuting the crime of genocide is as simple as that!!!! I would recommend the author for some more reading/studying. Name calling? The author does it perfectly.

Yvan Ntwari Am by no means an expert on ICTR issues but in my limited knowledge, the ICTR did not ever deny that the genocide took place. And they only failed to convict people for the Conspiracy to commit genocide but they did convict many on other genocide counts.

Charles Kambanda Yvan Ntwari, because the ICTR has confirmed that there was no ” planning” and all the top military and security leaders of that time were arrested and prosecuted but acquitted on genocide charges, we are left to wonder whether lower cadres along the leadership pyramid “executed” a genocide that was never planned. An unplanned but “executed” genocide? Really? Legal impossibility…read my submission above.

And that is where your opinions start. I read your submission but as you said, it is wondering and if it had been fully accepted by the court it would be law not wonder.
